1. Who we are and acceptance of these terms
This website, pizzadogbraziltx.com, is operated by Pizza & Dog Brazil, a restaurant located at 16206 Spring Cypress Road, Cypress, Texas 77429, United States ("we", "us", "our"). By browsing the website or placing an order you agree to these Terms & Conditions and to our Privacy Policy and Refund & Cancellation Policy. If you do not agree, please do not use the website.
2. Online orders
Submitting an order through the website is an offer to purchase the selected items. An order is accepted when the restaurant confirms it and begins preparation. We may decline or cancel an order when an item is unavailable, the delivery address is outside our service area, payment cannot be confirmed, the order appears fraudulent, or the restaurant cannot reasonably fulfill it — in which case any amount already paid for that order will be refunded.
3. Menu, prices and taxes
All prices are shown in U.S. dollars. Menu items, descriptions, ingredients, portion sizes and prices may change without notice, and occasional listing errors can occur; if an error materially affects your order we will contact you before preparing it. Applicable Texas state and local sales tax, any delivery charge and any tip you choose to add are shown during checkout before you confirm the order.
4. Delivery and pickup
- Delivery area. We deliver only to addresses inside our published delivery zone around the restaurant in Cypress, Texas. The website checks your address when you select delivery.
- Delivery times. Quoted preparation and delivery times are good-faith estimates, not guarantees. Traffic, weather and order volume can affect them.
- Receiving the order. Someone must be available at the delivery address to receive the order. If we cannot reach you or complete the delivery after reasonable attempts, the order may be treated as fulfilled.
- Pickup. Pickup orders should be collected at the restaurant at the time indicated. Please bring your order confirmation.
5. Payment
We currently accept cash on delivery or at pickup. If online card payment is offered in the future, payments will be processed by a licensed third-party payment provider under its own terms; we do not store card numbers on this website.
6. Cancellations and refunds
Because food preparation starts quickly, cancellation windows are short. Cancellations, complaints about order quality and refunds are handled as described in our Refund & Cancellation Policy. Nothing in these terms limits any right you may have under Texas law.
7. Food allergies and safety
Our kitchen prepares products containing (among others) wheat/gluten, dairy, eggs, soy, sesame and meats, using shared equipment. We cannot guarantee that any item is free of any allergen. If you or anyone in your party has a food allergy or dietary restriction, contact the restaurant at (832) 402-0536 before ordering. Consuming raw or undercooked foods may increase your risk of foodborne illness.
8. Accounts
Creating an account is optional. You are responsible for keeping your login credentials confidential and for activity on your account, and you agree to provide accurate contact and delivery information. You must be at least 18 years old to place an order, or do so with the involvement of a parent or guardian. We may suspend accounts used for fraud or abuse.
9. Acceptable use
You agree not to misuse the website: no attempts at unauthorized access, no interference with its operation, no automated scraping of its content, no fraudulent orders, and no unlawful, abusive or infringing submissions in any free-text field (such as order notes).
10. Intellectual property
The website's content — including the Pizza & Dog Brazil name, logo, photographs and text — belongs to us or our licensors and may not be reproduced for commercial purposes without permission. The underlying ordering software is open-source software used under its own license.
11. Third-party services
The website may link to or embed third-party services (for example Google Maps for directions). Those services are governed by their own terms and privacy policies, which we do not control.
12. Disclaimers and limitation of liability
The website is provided "as is" and "as available"; we do not promise uninterrupted or error-free operation. To the maximum extent permitted by applicable law, our total liability for any claim arising out of an order or the use of this website is limited to the amount you paid for the order concerned, and we are not liable for indirect, incidental or consequential damages. Nothing in these terms excludes or limits liability that cannot be excluded under Texas or U.S. law, and nothing waives rights that may exist under the Texas Deceptive Trade Practices – Consumer Protection Act.
13. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before starting formal proceedings, please contact us — most issues can be resolved quickly and informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction and venue.
14. General
If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms, together with the policies referenced in them, are the entire agreement between you and us regarding the website. We may update these terms from time to time; the version posted on this page at the time of your order applies to that order.
